1. Introduction
These Terms of Service ("Terms") are a binding agreement between you and Lead Skills, LLC, operator of Anaheim Hard Money Lenders and anaheimhardmoneylenders.com (together, the "Site"). By accessing the Site, submitting an inquiry, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the Site.
2. Our Role: Lead Generation Service
We operate a lead-generation service that connects borrowers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, pricing, underwriting, and funding, are made solely by the participating lender. Lenders are independent third parties and are not our agents or employees.
3. No Offer or Solicitation
Content on the Site is for general informational purposes only and does not constitute an offer to lend, an offer to arrange a loan, or a solicitation of any loan product. Program descriptions, rate ranges, leverage, and turnaround examples are illustrative and may change without notice. Availability and actual terms depend on borrower qualification, property characteristics, market conditions, and the underwriting practices of the participating lender.
4. Eligibility
You represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and that all information you submit through the Site is truthful, accurate, and complete. The Site is intended for use in the United States.
5. Your Consent to Be Contacted
When you submit an inquiry and check the consent box on our form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text or calling 714-451-4381. A current list of participating lenders is available upon request.
6. Equal Opportunity
Anaheim Hard Money Lenders connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.
7. Acceptable Use
You agree to use the Site only for lawful purposes and not to:
- Violate any applicable law, regulation, or third-party right.
- Submit false, misleading, fraudulent, or unauthorized information.
- Interfere with or disrupt the Site, its security features, or its underlying systems.
- Use automated means to access or collect data from the Site without our written permission.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is owned by or licensed to Lead Skills, LLC and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from Site content without our prior written permission, except as expressly permitted by these Terms or applicable law.
9. Third-Party Links and Services
The Site may link to or interoperate with third-party websites, products, or services, including participating lenders, analytics providers, and communication platforms. We do not control and are not responsible for the content, policies, or practices of those third parties. Your dealings with any third party, including any participating lender, are solely between you and that third party.
10. Disclaimers
THE SITE AND OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION OBTAINED THROUGH THE SITE WILL MEET YOUR REQUIREMENTS. WE DO NOT WARRANT THE ACTIONS, OMISSIONS, OR OUTCOMES OF ANY PARTICIPATING LENDER.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THESE TERMS, OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted on this page with a revised effective date. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
